Bowie is back to best on new album, critics say

LONDON (Reuters) - David Bowie's first album of new music in a decade sees the influential musician back to his best, critics said in reviews rushed out on Tuesday, two weeks before its release.

"The Next Day", which hits stores in Britain on March 11 and a day later in the United States, could even be the "greatest comeback in rock'n'roll history", according to The Independent's Andy Gill.

As well as a series of glowing reviews, this week also saw the launch of the second single from the 14-track album called "The Stars (Are out Tonight)", accompanied by a surreal video starring the Starman himself and Tilda Swinton as his wife.

In it the middle-aged couple's daily routine is upset by the arrival of a group of mysterious, androgynous celebrities next door who enter their dreams and reawaken old desires and fears.

"They burn you with their radiant smiles/Trap you with their beautiful eyes" read the lyrics on Bowie's official website.

As befits an "event" album with so much hype surrounding it, several newspapers gave The Next Day a track-by-track analysis.

"David Bowie's The Next Day may be the greatest comeback album ever," said Gill in his five-star assessment.

"It's certainly rare to hear a comeback effort that not only reflects an artist's own best work, but stands alongside it in terms of quality," he added.

Neil McCormick of the Telegraph also gave the record top marks, calling it "an ... emotionally charged, musically jagged, electric bolt through his own mythos and the mixed-up, celebrity-obsessed, war-torn world of the 21st century."

BOWIE MANIA

Even in an age when veteran musical comebacks are a daily occurrence, the fascination with Bowie appears to be huge.

Music magazine NME is dedicating a six-page cover feature to the singer, while the Victoria and Albert Museum in London is staging a major exhibition looking at his music, art and groundbreaking fashion.

More than 26,000 tickets have already been sold to the show, which opens on March 23.

Alexis Petridis, writing in the Guardian, argued that, while containing references to Bowie's past work, it largely avoided becoming a sonic memoir of a stellar musical career.

And he said that the secrecy surrounding the making of the album, and genuine media surprise when it was announced on Bowie's 66th birthday last month, risked overshadowing the quality of the music itself.

"That doesn't seem a fair fate for an album that's thought-provoking, strange and filled with great songs," he said. "Listening to it makes you hope it's not a one-off, that his return continues apace."

Songs singled out by critics included "Valentine's Day", couched, according to Gill, "in one of the album's most engaging pop arrangements", and "Dancing Out In Space", described by Will Hodgkinson of The Times as a "nightclub smash".

"You Feel So Lonely You Could Die", the penultimate track, provides the climax which McCormick calls "fantastic, a lush companion piece to Ziggy's Rock'n'roll Suicide that drips vitriol in place of compassion."

Now that the album is complete, the question on many fans' lips is whether Bowie will return to the stage to perform live.

The singer himself has dodged the limelight altogether since the comeback, but guitarist Gerry Leonard told Rolling Stone magazine that he thought it was "50-50" that Bowie would tour.

The glam-rock star, born David Jones in south London in 1947, shot to fame with "Space Oddity" in 1969, and later with his alter ego Ziggy Stardust, before establishing himself as a chart-topping force in the early 1980s.

His long absence from the music scene led to speculation he had retired, with British newspapers reporting as recently as October that he had disappeared from the limelight for good.

Bowie's last album of new material was "Reality", released a decade ago, and he underwent emergency heart surgery while on tour in 2004. His last stage performance was as a guest at a charity concert in New York in 2006.

Tributes have today poured in for shark attack victim Adam Strange following a moving tapu lifting ceremony at the beach where he died.

Strange died yesterday after being repeatedly dragged underwater by a massive shark, more than four metres in length, in full view of shocked fishermen and just a short distance from the beach, which was jammed with school children at the time.

Fishermen called desperately to Strange, a documentary maker and regular swimmer at the beach north of Auckland, to swim to a nearby rock, but they could only watch helplessly as the shark, believed to be a great white, attacked him.

Witnesses said up to four other sharks also swept in on Strange as blood spread through the water.

Armed police responded in a helicopter and an inflatable surf lifesaving boat, firing into the ocean to drive the sharks off so lifeguards could recover his body.

Rescue officials said this morning that they had film which showed at least two sharks circling. Beaches north of Manukau Harbour will be closed for the rest of this week.

Strange had been swimming from Maori Bay to Muriwai Beach, 200 metres from shore, in training for an Ocean Swim event.

This morning, between 100 and 200 people gathered for the tapu lifting ceremony led by by Ngati Whatua Nga Rima o Kaipara Trust chairman Malcolm Patterson.

Strange's grieving widow was supported by family colleagues from the film industry in which her late husband once worked.

They entered the water at the point Strange's body was pulled out, and stood there, with the water around their ankles, for a long period embracing. Others wrote messages of support in the sand.

Various lifeguards involved in yesterday's dramatic body retrieval from the sea were also present.

His family last night issued a brief statement, saying they were ''grieving the loss of a glorious and great father, husband and friend''.

''We are in deep shock and are still trying to contact overseas family members, so discretion and privacy would be appreciated until the family are ready to make any further statements,'' they said.

A surfing buddy said it was fitting that it took one of the ocean's biggest creatures to "take out" Strange.

Simon Shepheard said his friend was not intimidated by any environment.

"Waves were his specialty and he was training for the Rangitoto swim and that's why he pushed himself out into that environment.

"He was a really incredibly fit man with a well researched diet. He had a huge passion for life, lived in the moment and taught everyone else how to.

"He lived big moments."

Friends and family were gathering at Strange's widow Meg Thompson's home with flowers and baking.

Thompson was still too upset to talk with media, but Shepheard was happy to speak about the strong and talented man Strange was.

"I just think his death reflected his life.''

"He went through something that was everyone's worst nightmare but he's the only guy I know who could actually handle something like that in his head and could, in some really perverse way, understand what was going on."

"He was passionate, he had a really quick mind that was in demand all through Asia for his problem solving abilities when it came to film making," Shepheard said.

"He could go into a shoot, it doesn't matter what it was, and come out with a polished diamond."

An award-winning director, Strange had a background in painting, photography and graphic design.

On his web page, Strange wrote that when he got a spare five minutes, he liked to ''make a fruit smoothie, surf some big waves out on the West Coast, point my skis down a mountain with Meg, haul my mountain bike up and down a few hills, drink some Pinot while scratching away at a film script...''

Those who knew Strange have paid tribute to a talented man who was in love with the sea.

"Woke up this am still in shock that our friend Adam Strange was killed yesterday. like a surreal dream. He was so talented," Chrys Graham said.

"What a strange death for someone who was full of life... the guy was in love with sea... RIP Adam Strange," Josephine Ong commented.

"A river of tears for Adam Strange's family. Arohanui. You will come through this," Jessica Macc said.

SHARK 'WONT COME BACK'

Muriwai Surf Lifesaving chairman Tim Jago said this morning that everything pointed to the sharks being great whites, due to their size and behaviour.

The expert advice was that when injured, the sharks did not return to the same area. What wasn't known was how badly injured the main shark was after being shot at by a police officer.

Jago said the experts also pointed out there was no record of great whites making repeat attacks in the same places.

They had been scanning the water since yesterday and the sharks had not been spotted again.

Jago said their focus now was on helping Adam's wife and young daughter. They were a popular family in the community.

Jago said Strange was closely associated with the lifesaving club and played an active role in the lead up to last weekend's opening of newly upgraded facilities.

"He was always there at working bees on the end of a shovel," he said.

Jago said the beach was till closed to swimmers but Strange would be the first to encourage people to resume normal activity once all signs of danger had gone.

The first big test of public confidence would come this Sunday when junior lifeguard trainees aged between 5 and 14 were due to train.

ATTACKS OFTEN MISTAKEN IDENTITY

Niwa principal scientist Malcolm Francis said great white sharks were continually circling the New Zealand coastline in summer months, and would on occasion follow schools of fish inshore.

He had been studying and tagging great white sharks for a number of years and said four metres was a "fairly standard" size for a great white.

"That could certainly be a mature male, or if it's a female it wouldn't be mature because they can get quite a bit bigger."

Francis said he was "pretty certain" the shark had not been tagged.

Shark attacks were often cases of mistaken identity, but Francis said depending on a shark's age, they were attracted to eating different things.

"I guess it would be millennia of years of evolution that actually lets them know humans are not their natural food source.

"We don't have fins, and we move in different ways to fish and seals and their typical food sources."

Francis said for the most part, they might get close and investigate but would then typically move away.

"That does not mean you shouldn't get out of the water when one is near. Certainly get out of the water because it's very hard to know what sharks are going to do."

THE ATTACK

Witnesses yesterday recounted the horror of watching the attack from the shore.

Pio Mose, who was fishing on a rock near Maori Bay, just around a point from Muriwai Beach, said he called to the dying man.

''All of a sudden, we saw the shark fin and next minute, boom, attack him and then blood every where on the water.''

Mose dialed 111 and a friend ran to Muriwai to get life guards.

''He was still alive, he put his head up, we called him to swim over [to] the rock to where we were. He raised his hand up, and then while he was rising his hand up we saw another attack pull him in the water.''

Jago said the lifeguards who responded to the incident were shocked at the size of the shark. ''No one had seen anything this big out here ever.''

Muriwai had a history of shark attacks and there had been sightings earlier in the week of at least one large shark at Piha, 14km further south.

Since 1837, only 15 have been fatal, and great whites have been responsible for at least 11 of them.

The last confirmed shark death was in 1976, in Te Kaha, Bay of Plenty, when spearfisherman John Leith was attacked by what was thought to be a bronze whaler.

Tennessee HBCUs Take On Obesity - Higher Education

As a pre-med student and biology major, Fisk University junior Contessa Davis has learned largely through volunteering as a Student Health Ambassador in public health initiatives that it often takes the dedicated work of ?door-to-door canvassing? and other direct communication with individuals to persuade them to adopt healthy lifestyles.??

?The bottom line is that, whether it?s research or interventions to help individuals learn about healthy eating, the goal is to decrease the health disparities within our communities,? she says.?

This spring, Davis will be among a number of Fisk students and staff participating in an obesity awareness campaign at the Nashville-based historically Black private university. Last week, the Tennessee Department of Health (TDH) announced that Fisk and four other historically Black institutions are part of a grant program aimed at the schools educating their respective campus communities about the dangers of obesity. In addition to Fisk, the campaigns are under way at Tennessee State University in Nashville, LeMoyne-Owen College in Memphis, Knoxville College in Knoxville and Lane College in Jackson.

Lesia Walker, director of the TDH Office of Minority Health and Disparities Elimination, said the goals of ?these obesity awareness campaigns are to educate college students and others about the problems associated with being overweight or obese, and to engage them in activities fostering changes to improve lifelong health.?

?Statistics show a disproportionate number of African Americans are either overweight or obese, and we have to start reaching people with important messages earlier in life to make a difference,? Walker said in a statement.

Tennessee officials report that in 2011 the state had the sixth-highest rate of adult overweight and obesity in the U.S. at 66.5 percent. There are significant racial and ethnic disparities in the prevalence of obesity. Roughly two of every three Black non-Hispanic adults in Tennessee are overweight or obese. Black non-Hispanic women have the highest rate of obesity among any race or gender group, with one of every two Black women in Tennessee being obese, according to the TDH. Nationally, more than one-third of adults in the U.S. are obese, the Centers for Disease Control and Prevention reports.

For African-Americans who disproportionately suffer from diabetes, high blood pressure, certain cancers, heart attacks and heart and kidney failure, extra pounds can contribute to the severity of these adverse conditions. Additional weight also leads to higher health care costs, according to the TDH.

The Tennessee State University (TSU) program, which began last fall, involves ?targeting 1,200 first-year students in the required Freshman Orientation courses for the 2012-2013 school year? to educate them ?on health and fitness; increase awareness and easy access to nutrition health information in the campus cafeteria; and encourage physical activity to prevent obesity,? according to the TSU plan.

Other elements include healthy choice nutrition information labels placed on the commonly offered foods in the student cafeteria. Informational healthy choices and active lifestyle posters are being placed in the cafeteria, student center, and across campus to be renewed monthly so that new and fresh information is constantly available. The school received a $15,000 campaign grant for the 2012-2013 academic year.

Dr. Bill Johnson, the assistant dean for Teacher Education and Student Services at Tennessee State University (TSU), says the intent of the TSU campaign ?is to provide some information about the detrimental effects of obesity as well as provide some educational information to say ?choices matter,?? with respect to diet and nutrition.?

?The whole idea is on a college campus there?s a lot of opportunity to make some unhealthy eating choices. And so what we?re trying to do is trying to remind people that what they choose matters not just today but long-term,? Johnson says.

?There is an obesity epidemic in the United States. The HBCU community has a serious obesity issue and it needs to take responsibility?we need to take responsibility for our own community and move forward,? he adds.

Yvette Spicer, the campus community outreach coordinator at Fisk University, says the school has held public forums on obesity and is working with the school?s food vendor to increase awareness and availability of healthy meal choices for students. She noted that this spring and fall school and student government officials expect to organize a ?Biggest Loser? contest, which is based on the popular television show. The state awarded Fisk a $15,000 grant for the school?s obesity campaign for the 2012-2013 academic year.

Spicer explained that the Fisk obesity awareness campaign builds on the work of the HBCU Wellness program, which has been present at the school and the other Tennessee HBCUs since 2006. ?HBCU Wellness has operated in conjunction with Meharry Medical College and has been funded through the [Tennessee Department of Health].?

The program created the Student Health Ambassadors (SHAs), who are full-time students attending one of the participating institutions. The SHAs, such as Fisk?s Contessa Davis, work as health promotion and disease prevention advocates, and provide education in one of five health priority areas. The health priority areas include breast cancer, infant mortality, obesity, prostate cancer and sexually transmitted infections. Spicer says the SHAs have been active in the current obesity campaign at Fisk.

Tina Fey won't host Oscars -- who should?

He received decidedly mixed reviews for his Sunday night stint hosting the Oscars. She was mentioned, along with comedy partner in crime Amy Poehler, as a dream host for the future. But both Seth MacFarlane and Tina Fey have now gone on record saying they won't host next year's show.

In a comedy bit that opened the awards show, William Shatner muttered, "Why couldn't they get Tina and Amy to host? Why can't Tina and Amy host everything?"

Fey told The Huffington Post that she was flattered "to be Shatnered," but said she won't be looking to host the show.

"I just feel like that gig is so hard," Fey told the site. "Especially for, like, a woman -- the amount of months that would be spent trying on dresses alone ... no way."

When writer Mike Ryan pushed Fey, asking if there was a "one in a million chance," she still declined, saying "I wish I could tell you there was."

As for MacFarlane, he responded to a Twitter fan who asked him if he'd host again with "No way. Lotta fun to have done it though."

With Fey and MacFarlane out of the running, the Academy organizers will have to start combing through a long list of possible hosts. Recent hosts have included Billy Crystal, James Franco and Anne Hathaway, Alec Baldwin and Steve Martin, Hugh Jackman, Jon Stewart and Ellen DeGeneres.

It's a list that heavily favors comedians, but there the Academy walks a fine line. Edgy comics like MacFarlane and three-time Golden Globes host Ricky Gervais may appeal to a younger audience, but also run the risk of alienating viewers who like their Oscar humor safe and friendly. And there's no denying it's a great deal of work for a famous name who arguably doesn't gain much from taking the job but has a lot to lose if his or her hosting night goes awry. It might even be easier to win an Oscar than to successfully host one.

Apple Patents Situational Awareness And Location Information Sharing For Mobile Devices

Screen Shot 2013-02-26 at 8.42.40 AMApple was issued a couple of interesting new patents today (spotted by AppleInsider), including one that could make an iPhone aware of changes in a user's situation, and alter phone settings accordingly. That would make for a mobile phone that might be able to automatically switch to silent mode when in a movie theatre, for instance, or which could wake from sleep upon being pulled out of a pocket.

Agent: Cop was ?dying to taste some girl meat?

Cheerful written exchanges between a police officer and women from his past appeared in a sinister new light when an FBI agent described at the officer?s criminal trial how he talked on the Internet about killing and eating the women.

?I?m dying to taste some girl meat,? Agent Corey Walsh testified Tuesday that New York Police Officer Gilberto Valle told one of the online friends he met who shared an appetite for human flesh.

The testimony came on the second day of testimony in federal court in Manhattan for the 28-year-old Queens resident charged with conspiring to kidnap women and illegally accessing a government database to research potential victims. If convicted, he could face life in prison.

It came a day after his 27-year-old wife told jurors she fled their home in September with their 1-year-old daughter after discovering that Valle spent hours a night on extreme sexually violent websites and one that catered to those interested in cannibalism and asphyxiation. In Reno, Nev., she turned over a computer to the FBI that contained hundreds of Valle?s emails and instant messages with what the government has described as co-conspirators.

To prove the plots involved real women and to counter defense claims that it was all fantasy, the government summoned several women to testify about their dealings with Valle before prosecutors say he wrote about them as potential targets and, in two cases, potential meals.

The women included a former high school classmate, two former college classmates and an 18-year-old woman who attended Valle?s high school alma mater and said she had no contact with him before he described her to one of his Internet friends as ?the most desirable piece of meat I?ve ever met? and small enough to fit in his oven.

Kimberly Sauer, of Germantown, Md., went to the University of Maryland with Valle and had nothing bad to say about her former classmate. On cross-examination, Sauer told defense attorney Julia Gatto that she never felt threatened by Valle.

Sauer learned of the case only after she received from Valle?s wife last year in the middle of the night a disturbing Facebook message that sounded so crazy that she texted him to warn that the account must have been hacked. Either that ?or you?re trying to sell me into white slavery,? she recalled joking in the text.

But Walsh said Valle?s computer had a file titled ?Abducting and Cooking Kimberly: A Blueprint,? which included a photo of Sauer.

Sauer came up frequently as a subject in online chats between Valle and a man in Great Britain who used Moody Blues as a screen name and MeatMarketMan as part of his email address, the agent testified. Walsh said Moody Blues told Valle he had fantasized about cannibalism since he was 6 years old but did not fulfill the desire until 35 years later.

In one correspondence, Valle suggests a woman named Kimberly ? prosecutors say Sauer ? would be easy prey because she lived alone.

?I can knock her out, wait until dark and kidnap her right out of her house,? he wrote, according to prosecutors.

The agent said Moody Blues suggested eating their victim alive but Valle responded: ?I?m not really into raw meat.?

Walsh said they also discussed cooking Sauer, basted in olive oil, over an open fire and using her severed head as a centerpiece for a sit-down meal.

?I just can?t wait to get Kimberly cooking,? the agent quoted Valle as saying.

In a chat, Valle told Moody Blues he was meeting Kimberly for lunch on Sunday and that she would be ?kidnapped in a couple of months.?

Moody Blues told him he?d ?given thought to your ideas about cooking her alive.?

?Give me some ideas,? Valle said.

Moody Blues suggested ?cutting her feet off and cooking them on the BBQ in front of her.?

?I suppose that?s a possibility,? Valle said. ?You are the one with the experience.?

Walsh also described communications between Valle and his co-defendant, Michael Vanhise, of Trenton, N.J. He said the two negotiated the price to be paid for a Manhattan teacher to be taken to New Jersey in a suitcase for Vanhise to rape and kill.

The agent said Valle asked Vanhise whether he wanted the woman clothed or naked and Vanhise said he wanted her clothed.

?Excellent. I?ll leave her clothes on. I?ll give you the pleasure of unwrapping your gift,? Valle was quoted as saying.

(AP) ? Miguel Diaz-Canel has five years to get started and a lot of work to do.

The man tapped as Cuban President Raul Castro's chief lieutenant and likely successor must quietly fend off any challenges from within the Communist-run island's secretive citadel of power.

He must gain legitimacy with young, and even middle-aged, Cubans who have never known a leader not named Castro. And he must deal with an exiled diaspora and American officials who were already making clear on Monday they will not be mollified by a new, younger face.

"There's going to be a huge charisma deficit," said Ann Louise Bardach, author of "Without Fidel: A Death Foretold in Miami, Havana and Washington." ''You go from Fidel to Raul who at least had some of the shine of the Castro mantle, somebody who fought in the revolution."

She said Cuba faces "massive" problems including a large public debt, dependence on Venezuela, an aging population, decades of brain drain and one of the world's slowest Internet connections.

Whether Diaz-Canel is the man to fix all that is very much open to debate. Will Cubans accept another leader who was hand-picked from above and whose ascension ? if it happens ? will not come through multiparty democratic elections?

And will those passed over for the top job fall in line? If Fidel and Raul Castro are still alive, will the 52-year-old electrical engineer and former minister of higher education be able to set his own course?

On the streets of Havana, a day after Castro accepted a new term and said he would step down when it ends, many had their doubts about the future.

"Change? Was there a change?" asked Ernesto Silva, a 25-year-old student who scoffed at the idea that the country must wait another five years for new leadership, and said he hopes to emigrate to the United States in the meantime. "I find it hard to believe that he will be able to do, say or truly change anything."

Others were more enthusiastic, but still unsure how Diaz-Canel will establish control.

"I think it is good. He is a new and young figure. But he was trained by the old guys," said Maria Quesada, a 45-year-old office worker. "We still can't talk about a government without Castro because he's still going to be there, and I think the true test for Diaz-Canel will be when his vision differs from Raul's."

Raul himself faced a similar challenge when he took over from the ailing Fidel in 2006. The younger Castro was seen as a bland and unassuming figure who had always operated in the shadow of his larger-than-life older brother.

But he has overseen a series of sweeping changes since then in an effort to right the country's ever-weak Marxist economy, expanding private enterprise, legalizing a real estate market and eliminating most travel restrictions.

Behind the scenes, Raul has led an anti-corruption campaign and replaced many of Fidel's confidantes with loyal military officials who earned his trust during his four plus decades as the nation's armed forces chief.

Observers say it is those men, who have been put in charge of important state-owned enterprises like the phone company, the enormous holding company Cimex and virtually the entire tourism industry, who Diaz-Canel must persuade to follow him.

"I'm sure he's shown himself to be acceptable to the military already, otherwise this would never have happened," said Paul Webster Hare, the British ambassador to Cuba from 2001 to 2004 and now a lecturer in international relations at Boston University. "He has to be acceptable to them."

In Washington on Monday, State Department spokesman Patrick Ventrell said the U.S. remained "hopeful for the day that the Cuban people get democracy, when they can have the opportunity to freely pick their own leaders."

"We're clearly not there yet," he added.

Ventrell said Cuba needed to do more to open up if it wants repaired relations with the United States.

Still, observers said the naming of a successor, along with the economic and social changes Castro has instituted, could eventually lead to detente, or at least an easing of bad blood.

"There is a psychological and political benefit to naming somebody now," said Julia Sweig, a Cuba expert at the Washington-based Council on Foreign Relations. "It can demonstrate to the United States that there is an opportunity to change how we relate to this new Cuba."

Reaction to Diaz-Canel's promotion was met with a shrug by Cuban-American politicians who said that changing the nameplate outside the presidential office won't alter a system they see as repressive and undemocratic. And some analysts and exiles in South Florida questioned whether he will survive politically long enough to ever take control.

Little is known of Diaz-Canel's relationship with Cuba's other political or military elites, or his own personal ideology.

He is said to be a fan of the Beatles who in his youth wore his hair long at a time when both acts were considered anti-revolutionary. And a former colleague says he is a private jokester despite his somber public demeanor.

Like almost all Cuban politicians who earned their stripes by mastering the art of backroom party maneuvering, Diaz-Canel seems to have learned long ago that there was no benefit to putting himself in front of the cameras.

It was a lesson he probably learned back in 2002, when fellow young turk Roberto Robaina was dumped as foreign minister after being accused of "political and ethical errors."

Diaz-Canel, who was part of Robaina's circle, not only survived the purge and a subsequent one that took down the next foreign minister and a prominent young vice president ? but he appears to have thrived behind the scenes.

Robaina, who now paints pictures and runs a private restaurant in Havana, would not comment Monday on Diaz-Canel's rise. But a former colleague who has known Diaz-Canel since the 1980s said his career really began to take off after the purge.

In 2003, he was named head of the Communist Party in Holguin, a role he had held previously in his native Santa Clara. The same year, Raul Castro helped get him a seat on the Political Bureau, the island's equivalent of a Politburo.

The experience in Holguin was a trial by fire for Diaz-Canel, who had been popular in Santa Clara but met resistance in his new role.

"People didn't like him in Holguin," said the former colleague, who would speak only on condition of anonymity because of the sensitivity of the matter. But he caught Castro's eye, and earned his praise.

"He has demonstrated a solid ideological firmness," Castro, who was then vice president himself, said of his protege, perhaps presaging his future rise.

Cuban officials insist that a post-Castro era will be no different and that the nation's institutions will unquestionably back the new prince. They point to a long history of exiles wrongly predicting the collapse of the revolution, which has so far survived the demise of the Soviet Union and retirement of Fidel Castro, not to mention Washington's 51-year economic embargo.

But Hare, the former ambassador, says it would be a mistake to underestimate the challenges Diaz-Canel would face getting state machinery and political rivals to fall in line.

"Does he have rivals in the 50-something generation in Cuba who perhaps resent what happened?" Hare asked. "There is a scenario where other people will be sensing ... that Diaz-Canel doesn't have all the attributes of the Castros and therefore (will ask) 'Why shouldn't I have a chance at it?'"

Fine print may protect NASCAR from lawsuits

(Reuters) - Spectators injured when they were hit by wreckage from a crash at a NASCAR race on Saturday face a significant obstacle if they want to pursue injury lawsuits against Daytona International Speedway, its owner and the sport's governing body NASCAR: the fine print on their tickets.

Lawyers say that in the event of litigation arising from the pile-up at a second-tier Nationwide race, NASCAR (the National Association for Stock Car Auto Racing), Daytona speedway and its owner, International Speedway Corporation, would likely point to the disclaimers displayed on auto-racing tickets, which are designed to inform buyers of potential dangers and waive any personal injury liability.

Spokespeople for Daytona International Speedway, International Speedway Corporation and NASCAR did not respond to requests for comment for this story.

About 30 spectators were injured when the crash propelled debris, including at least one tire, through and over the fence meant to protect the crowd. Two spectators who were originally listed as critical on Saturday were described as in stable condition on Sunday. Others were either in stable condition in hospital or had been treated and released.

The disclaimer on a Daytona ticket says: "The holder of this ticket expressly assumes all risk incident to the event, whether occurring prior to, during or subsequent to the actual event, and agrees that all participants, sanctioning bodies, and all employees, agents, officers, and directors of Daytona International Speedway, its affiliates and subsidiaries, are hereby released from any and all claims arising from the event, including claims of negligence."

It has become common practice for sports businesses to place the disclaimers on the back of ticket stubs for admission to a variety of venues, such as ski resorts, hockey arenas and baseball fields, lawyers said.

Lee Kaplan, a trial lawyer who has defended Chrysler Group and Toyota Motor Corporation in product liability cases, said he felt the language in the Daytona disclaimer should be enough to cover possible claims arising from the Daytona crash. He said spectators understand the risk they are taking by buying a Daytona ticket.

"They are held to the knowledge that racing is inherently dangerous and spectators can be injured," said Kaplan, a Houston lawyer, noting that the word "risk" in the disclaimer captures that sentiment.

But one question that might arise could be whether the disclaimers are enough to offset any questions about whether the organizers provided strong enough fencing and appropriate seating arrangements to keep fans safe from danger, personal injury lawyers said.

If it were proven that Daytona knew that the fans were in harm's way and opted against taking action such as changing the fans' seating arrangement or setting more distance between the safety fence and the track, then potential injury claims were more likely to supersede any so-called "buyer beware" ticket disclaimer, Dan Kirschner, a Chicago personal injury lawyer.

Oakland-based attorney Bob Eassa, who has defended the Oakland Raiders in a variety of personal injury lawsuits by NFL players, said the disclaimer only covers "normal risk" and that the notice cannot remove claims of negligence if the company were proven to have acted inappropriately.

He said other legal claims that a ticket disclaimer would not waive are related to product liability. The injured could claim, for instance, that International Speedway Corp and the construction company it used to make the safety fence did not use strong enough materials to prevent debris from flying into the stands and injuring spectators.

"You're attacking the fact that they didn't do it right," Eassa said.

By Monday morning, there were no reports of lawsuits being filed over the crash.

Saturday's wreck happened after driver Regan Smith, who was leading the race, attempted to block another driver as they were nearing the checkered flag in the final lap of the race and hit the other car, a report on NASCAR.com said. This led to a pile up that sent driver Kyle Larson's car airborne and ripped out its engine, sending the debris into the crowd. He walked away from the wreckage unhurt.

NASCAR has required tracks to have $50 million in insurance to cover spectator injuries, money that would be used to cover lawsuits against it, according to SEC filings.

International Speedway Corp has rarely defended itself in public lawsuits against NASCAR fans over personal injury claims arising from accidents at its racetracks.

Recent accidents at NASCAR racetracks include last year's lightning strike at Pocono Raceway, which killed one fan and injured nine others, and a 2009 crash at Talladega Superspeedway when a car hit the catch fence and flying car debris flew through the fence and broke an 18-year-old's jaw.

No disclosures of any lawsuits related to either instance could be found in International Speedway Corp's SEC filings, nor any other personal injury claim over the past three years. An online and federal court search of the Pocono and Talladega incidents didn't turn anything up either.

Justin Reiff, an expert in amusement park litigation, said that large companies at risk of injury lawsuits typically quash personal injury claims by offering victims a large, upfront confidential settlement before they file a public lawsuit.

I was happily surprised to see Hunter Walk interview Jason Kincaid, one of the first TechCrunch employees. The interview is here and I’m reprinting it below. It was true. And then it wasn't. Now, here at MWC in Barcelona, Samsung has finally confirmed its rumored March 14th launch event for the much-anticipated Galaxy S IV. The smartphone giant's latest flagship is set to debut in New York City, apparently by popular demand. "We introduced the Galaxy S III in London last year," Samsung Electronics' mobile division chief JK Shin told Edaily news. "This time we changed the Venue (to New York)... as we were bombarded with requests from US mobile carriers to unveil the Galaxy S IV in the country." As with any such announcement, details are sparse at best, so we'll need to wait a few more weeks before confirming specs and appearance for the Galaxy S III successor. After election win, Anastasiades tackles Cyprus bailout

NICOSIA (Reuters) - Cypriot president-elect Nicos Anastasiades, armed with a clear mandate from voters to spare the island from insolvency, said on Monday he was committed to reforms in return for a financial bailout.

The Conservative Anastasiades won decisive backing in a presidential election on Sunday for an aggressive approach to resolving the island's worst financial crisis in four decades.

Less than 24 hours after his resounding victory on Sunday, Anastasiades said he would appoint Michael Sarris, a former World Bank economist who enjoys broad respect at home and abroad, as his finance minister.

Anastasiades has promised a quick deal with foreign lenders and to bring Cyprus closer to Europe, in a shift from the policies of the outgoing Communist government that first sought aid from Russia before turning to the European Union.

"Long-term prospects for Cyprus are excellent as we are committed to carrying out necessary structural reforms. We only need a helping hand now," Anastasiades told Germany's Bild newspaper, according to advance excerpts of an interview to be published in Tuesday's edition.

Christopher Pissarides, a Nobel laureate for economics in 2010, was appointed head of a group of consultants to the government on the economy.

Sarris, a soft-spoken and down-to-earth economist known to many Cypriots by his first name, successfully ushered Cyprus into the euro zone during a stint as finance minister between 2005 and March 2008 under a previous center-left government.

He had refused a ministerial appointment by the outgoing Communist-led government in mid-2011, saying he needed a clear mandate to handle a then-looming financial crisis.

"I think it is a very strong choice, he is clearly respected in the EU but also in the U.S., which could be important for getting IMF support for a bailout." economist Fiona Mullen said, referring to Sarris's appointment.

SMALL ISLAND, BIG PROBLEM

Eight months of talks on a bailout package have turned Cyprus, one of the euro zone's smallest economies, into a big headache for the currency bloc, triggering fears of a financial collapse that could reignite the European debt crisis.

Anastasiades will be sworn in on February 28, and fully assume duties on March 1. With state funds depleting rapidly and a 1.4 billion euro ($1.9 billion) debt maturing in June, he has little time.

In a joint statement on Monday, the French and German finance ministers said talks must begin with prospective lenders soon so a deal can be reached by the end of March.

Cyprus sought aid from the EU and the IMF last June, after a Greek sovereign debt restructuring saddled Cypriot banks with losses. It is expected to need up to 17 billion euros in aid - about the size of its entire economy.

"There is a pressing need to recapitalise our banking sector," Anastasiades told Bild. "I agree with Germany and France that we should reach an agreement by March."

Virtually all rescue options - from a bailout loan to a debt writedown or slapping losses on bank depositors - are proving unpalatable because they push Cypriot debt to unmanageable levels or risk hurting investor sentiment elsewhere in the bloc.

Although a draft bailout deal says banks may need "up to" 10 billion euros to recapitalise, a banking source said an asset review still under wraps has earmarked between 5.98 billion and 8.86 billion euros for banks.

With Cyprus's fiscal needs at 7.0 to 7.5 billion over the next four years, the final bailout could reach 16 billion euros.

GERMAN WORRIES

German misgivings about Cyprus's commitment to fighting money laundering and its strong financial ties with Russia - which has already extended a 2.5-billion-euro loan to the nation - have further complicated negotiations.

Known for his no-nonsense style and impressive access to European policymakers such as German Chancellor Angela Merkel, Anastasiades took 57.5 percent of the vote in the run-off election, 15 points ahead of his anti-austerity Communist-backed rival Stavros Malas.

"Money laundering is a global problem and no country can remain immune to this problem. However I believe the comments about Cyprus are wrong and exaggerated. We have gone through proper checks," Anastasiades said.

The island was ready to agree to further inspections by international or European committees and take on board proposals for improvement, he said.

Cyprus has been shut out of international capital markets for almost two years, with the outgoing administration resorting to heavy borrowing from state-owned corporations to pay public sector salaries.

Yet prices on the island's internationally traded bonds have rallied in recent weeks. The quoted yield on a Cypriot 10-year benchmark bond has fallen to an 18-month low of 9.45 percent, according to Thomson Reuters data.

A spokeswoman for Israel's Prison Authority said that the detainee, 30-year-old Arafat Jaradat, had apparently died of cardiac arrest. An emergency service team had tried to resuscitate him but failed, she said.

Tension over the issue of Palestinian prisoners held by Israel has risen over the past few weeks, with mass protests held in support of four inmates on hunger strike and dozens of demonstrators injured in ensuing clashes with Israeli forces.

"Our information was that Jaradat was being interrogated and then he died. Therefore we call for an international investigation into his death, that may have resulted from torture," Palestinian Minister of Prisoners Issa Qaraqea said.

Qaraqea did not elaborate on whether or not he had actual evidence of torture.

Israel's internal security service, Shin Bet, said in a statement that Jaradat began feeling ill after eating lunch, while he was resting, and that a police inquiry into the circumstances of his death had begun.

"During his interrogation ... on Thursday, Jaradat was examined numerous times by a doctor. No health problems were found in these examinations and the interrogation continued," the Shin Bet said.

Jaradat, according to Shin Bet, suffered from various health problems prior to his arrest, including back aches and injuries in his leg and stomach, sustained from a rubber bullet and a tear gas canister.

But Qadoura Fares, chairman of the Palestinian Prisoner Club, a leading association that cares for Palestinians in Israeli jails, said that according to the group's records, Jaradat did not suffer from any prior illness.

"Israel was responsible for his life," Fares said.

Jaradat was arrested this week under suspicion he was involved in stone-throwing that had wounded an Israeli in the occupied West Bank, the Shin Bet said.

Israel holds around 4,700 Palestinians in its prisons on charges ranging from throwing stones to killing Israelis. Palestinians widely regard them as heroes of their national struggle against Israel and want them all freed.
